Welcome to Scratch. These Terms & Conditions (“Terms”) govern your access to and use of our website, mobile apps and services (collectively, the “Services”). By using our Services you agree to these Terms. If you do not agree, please do not use the Services.
1. Eligibility
- You must be at least 18 years old to use the Services. By registering you represent that you meet this requirement and have authority to enter into these Terms.
2. What the Services Are
- Scratch provides an online marketplace that connects Clients (people who want photos) with independent Photographers (service providers who typically use their own smartphone to take photos).
- We enable search, booking, messaging, digital delivery and (where applicable) payment processing. Scratch does not itself provide photography services.
3. Independent Contractors
- Photographers who accept gigs through Scratch are independent contractors. They are not employees, agents, or partners of ScratchFoto LLC. Scratch has no direct control over their methods of work beyond the platform features and policies.
4. Accounts, Registration & Security
- You must provide accurate account information and keep it up to date. You are responsible for activity on your account and must keep login credentials secure.
- We may suspend or terminate accounts for violations of these Terms or for other legitimate reasons.
5. Booking, Payments & Fees
- Booking fees, subscription terms, and any promotions are described at time of booking. Payments may be processed by third-party payment processors; their fees, terms and privacy practices may apply.
- Refunds, cancellations, and disputes are handled according to the policy in effect at the time of the booking. Scratch may withhold, reverse, or hold funds to resolve disputes or comply with applicable law.
6. Trials & Earnings
- Any free trials or earnings estimates are described clearly where offered. Earnings shown in marketing materials or case studies are illustrative only and not guarantees of income. Actual earnings depend on many factors.
7. User Conduct & Content
- You must use the Services lawfully. Prohibited conduct includes harassment, illegal activity, hate speech, posting unlawful content or violating others’ intellectual property or privacy rights.
- Photographers must comply with local laws, permits and venue rules when shooting public or private locations.
- By uploading content (photos, profiles, reviews) you grant Scratch a non-exclusive, worldwide license to host, display and promote that content to operate the Services.
8. Safety, Verification & Disclaimers
- We may provide verification features (IDs, ratings, reviews) to help users make informed choices. These features are aids only and do not guarantee safety or quality.
- You accept the inherent risk of interacting with third parties. Scratch is not responsible for the acts, omissions, or suitability of other users.
- Services are provided “as is.” To the extent permitted by law, Scratch disclaims all warranties.
9. Intellectual Property
- Scratch and its licensors retain all rights in the platform, trademarks, logos and content. You may not copy or use our intellectual property without permission.
- Photographers retain ownership of original photos they create unless a different agreement is made. By uploading media you grant Scratch the license described in Section 7.
10. Ratings, Reviews & Moderation
- Ratings and reviews help maintain quality. Do not post defamatory, abusive or spam content. Scratch may remove reviews that violate policy.
11. Limitation of Liability
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCRATCHFOTO LLC’S LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO SCRATCH IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS (US$100). SCRATCH IS NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR EXEMPLARY DAMAGES.
12. Indemnification
- You agree to indemnify ScratchFoto LLC from any third-party claims, liabilities, losses or expenses arising from your breach of these Terms or your misuse of the Services.
13. Termination
- Scratch may suspend or terminate accounts for violations of these Terms. Termination does not limit our other rights or remedies.
14. Dispute Resolution & Governing Law
- These Terms are governed by the laws of the State of California, USA. Any disputes will be brought in the state or federal courts located in Los Angeles County, California, unless otherwise agreed or required by law.
15. Advertising & Marketing Claims
- All marketing and advertising must be truthful and comply with platform rules (Apple, Google, Meta) and applicable laws. Earnings claims must be presented as illustrative and not guaranteed.
16. Changes to Terms
- We may update these Terms. We will post the “Last updated” date at the top and notify users as required. Continued use after changes constitutes acceptance.
17. Privacy
Our Privacy Policy explains how we collect and use personal information. By using the Services, you agree to the Privacy Policy:

C. Short Cancellation / Refund Summary (For App Store link or FAQ)
- Cancellations: Clients may cancel bookings as allowed by the session’s cancellation window shown at booking. Cancellation rules and any applicable refund amounts are presented at checkout.
- Refunds: Refunds are considered case-by-case. Scratch may issue refunds where bookings could not be fulfilled or in accordance with applicable law and the cancellation policy.
- Disputes: If you have an issue with a session, please contact support at support@theappscratch.com and include booking details for a timely review.
